    So... I just left the dealer... I got the car fax.
    1 owner, no accidents BUT
    it failed emissions in march, and April before the owner traded it in...
    This concerns me a bit as I feel the own said
    "F this car" and traded it in.

    In NY, a dealer can't sell a car that doesn't pass inspection. Also as far as I'm aware even in private sales unless explicitly stated in the bill of sale ("car being sold as is and in need of repair") the seller is responsible for getting the car to pass inspection (I could be mis informed though).
    Either way, ask the dealer why it failed and what was fixed or repaired.
    My 07 had a CEL (SAI pump) when I bought it. Out of state dealer said they fixed it but when I got I home the cel popped back on. I brought it back to said dealer and they fixed it.
    Unless the car was modified in such a way where the emissions equipment is no longer installed anything can be fixed.

    If its modified in terms of emissions equipment it is not legal in any state. Either way a car that fails emissions isn't easy to live with. You'll need it street legal.

    My point was to verify WHY it failed before automatically thinking its going to be a nightmare. Could just be a faulty piece of hardware (like my busted SAI pump at 60k miles)

    I actually went BACK to the dealer to double check a few things...
    the clock, rear view mirror compass, and BOTH electric side mirrors didnt work. Oh, and the windshield has a crack like a rainbow going from one side to the other...
    aside from all that, I asked about it not passing emissions, and the dealer told me
    "my advice to you, is after you buy it take it to emissions to see whats wrong with it"

    Laws differ from state to state. Most of them slap on "As Is!" as a catch all for selling broken cars.

    I've seen it here. It's definitely not legal, but a dealership sold a friend of mine a car with a catless exhaust. She only found out 2 years later when she attempted to register the car in VA.
