    You're lucky your parents let you do this. But just a heads up, if you're not living at home, it can be considered insurance fraud, especially if the car is not parked where the policy says it's parked. Also, I don't suggest letting your parents do that, eventually you'll have to get off their policy (you should already be if you don't reside at home) and it could be a major blow to your finances. Just a heads up on things I learned from my youth. The earlier you establish your own insurance identity, the sooner you'll have affordable rates for nice cars.

    There is no law about whether or not he is the primary driver. However, lots of people list their children as the secondary driver when that is not the case. I'll have to ask my wife if that's legal or not, I assume it is not. That's not the real issue though, if you live on your own and are self sufficient, you're supposed to have your own insurance policy. Being on your parents policy implies that you are still their dependent residing in their household. It would be like trying to carry a sibling who lives half way across the country on your insurance policy. Most companies will not let you do this. Depending on the severity of the fraud would determine jail time. I believe the worst case scenario here would be that insurance doesn't pay out for an accident he is at fault for and his entire family gets dropped. However, with him being a college student, most companies will allow him to stay on his parents policy as long as he is a full time student. Companies do have an age limit on being carried on your parents policy as well.
